Terms of Service

These Terms of Service ("Terms") govern your access to and use of PolySub (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

The Service allows users to upload video files and generate subtitle output in the form of either a VTT subtitle file or, where selected, a video file with burned-in subtitles.

1. Eligibility

You must be legally able to enter into this agreement. If you use the Service for a company or organization, you confirm that you are authorized to accept these Terms on its behalf.

2. Accounts

You are responsible for your account, login credentials, and all activity under your account. You must provide accurate information and notify us promptly if you believe your account has been accessed without authorization.

3. Your Content

You retain ownership of the video files and other content you upload to the Service ("User Content").

You grant us a limited, non-exclusive, royalty-free license to host, store, process, subtitle, translate, convert, and deliver your User Content solely as necessary to operate and provide the Service.

You are solely responsible for your User Content and represent that:

• you have all necessary rights and permissions to upload and use it;
• your User Content and use of the Service do not violate any law or third-party rights;
• you have obtained any required consents from persons appearing or speaking in the uploaded content.

4. Output

The Service uses automated systems to generate subtitle output from uploaded videos.

The output of the Service is limited to:

• a VTT subtitle file; and
• a video file with burned-in subtitles, if that option is selected.

Output may contain errors, omissions, mistranslations, formatting issues, or timing issues. You are solely responsible for reviewing and approving all output before publishing, sharing, distributing, or relying on it.

The Service is not intended, without human review, for legal, medical, regulatory, accessibility-compliance, or other high-risk use cases.

5. Acceptable Use

You may not use the Service to:

• upload unlawful, infringing, harmful, or abusive content;
• violate the intellectual property, privacy, or other rights of others;
• interfere with or disrupt the Service;
• bypass usage limits or technical restrictions;
• upload malware or other harmful code;
• reverse engineer or misuse the Service.

We may suspend or remove content or accounts if we reasonably believe it is necessary to enforce these Terms, comply with law, or protect the Service or others.

6. Credits, Payment, and Billing

The Service uses a prepaid credit model, not a subscription model.

6.1 Credit Purchasing

Users may purchase credits through Stripe payment processing. Once purchased, credits are deposited into your account. We reserve the right to change pricing at any time, but price changes apply only to new purchases, not to credits already held in your account.

6.2 Credit Usage and Requirements

The number of credits required to process a video depends on:

• the duration of the video;
• whether you select output as a VTT subtitle file only or include a video file with burned-in subtitles.

You must have sufficient credits available to complete a processing request. If you do not have enough credits, the request will be rejected and no credits will be deducted.

6.3 Credit Restrictions and Terms

Unless stated otherwise:

• credits are prepaid and non-refundable except where required by law;
• credits are personal and non-transferable between accounts or users;
• credits are not redeemable for cash or other payment methods;
• unused credits may expire after 12 months of account inactivity or as stated in your account;
• credits cannot be sold, traded, or transferred to third parties.

6.4 Refunds and Disputes

All credit purchases are final and non-refundable except where applicable law mandates otherwise. If you believe you have been charged in error, contact us at support@polysub.app within 30 days of the transaction.

6.5 Payment Processing

Payments are processed by Stripe. By purchasing credits, you authorize us to charge the payment method you provide. You are responsible for maintaining accurate billing information. Failed payments may result in service suspension.

6.6 Price Changes

We reserve the right to modify credit pricing or credit usage requirements at any time. Changes apply only to new purchases and do not affect previously purchased credits. We will notify users of significant changes where feasible.

7. Storage and Availability

We may store uploaded files and generated output for a limited period in order to provide the Service.

You are responsible for downloading and keeping your own copies of any output. All output is automatically deleted after 24 hours.

We aim to keep the Service available, but we do not guarantee uninterrupted, secure, or error-free operation.

8. Privacy

Use of the Service is also subject to our Privacy Policy.

If you upload content containing personal data, you are responsible for ensuring that you have a valid legal basis and any required notices or consents under applicable law.

9. Intellectual Property

The Service and all related software, branding, design, and platform content are owned by us or our licensors.

Except for the limited rights expressly granted in these Terms, no rights in the Service are transferred to you.

10. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if you violate these Terms, fail to pay, create legal or security risk, or misuse the Service.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

We do not guarantee that the Service will be uninterrupted, error-free, or that any output will be accurate, complete, or fit for a particular purpose.

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or loss-based damages, including loss of profits, revenue, data, or business opportunity.

To the fullest extent permitted by law, our total liability arising out of or relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or EUR 100 if you have not made any payment.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Governing Law

These Terms are governed by the laws of Sweden.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the courts of Sweden, unless mandatory law provides otherwise.
